If your property is outside Bellingham city limits but within Whatcom County, you're governed by the county's ADU regulations under WCC 20.80.910. The 2025 Comprehensive Plan update brought significant changes to ADU rules — particularly for properties within Urban Growth Areas (UGAs).

UGA Properties vs Rural Properties
Urban Growth Area (UGA)
- Up to 2 ADUs per lot (2025 updates)
- Max ADU size: 1,248 sq ft
- Reduced parking on lots under 6,000 sq ft
- Condo ownership allowed
- Zero-lot-line DADUs allowed if abutting public alley
- Existing structure conversions allowed (even nonconforming)
Rural / Unincorporated
- Detached ADUs generally require 4.5+ acres
- Septic system capacity is the #1 limiting factor
- Septic/well upgrades may cost $15,000–$30,000
- Health Department review required
- Attached ADUs may still be possible on smaller lots
- Longer permit timelines: 8–12 weeks

Where the 2025 Updates Apply
The new UGA amendments apply to eligible lots within Urban Growth Areas. They EXCLUDE: Lake Whatcom Watershed, General Commercial, Agriculture, Rural, and Rural Forestry zones.

ADU Size Limits
County ADUs generally cannot exceed 1,248 sq ft and must be "subordinate" to the primary residence. This is more generous than Bellingham's 1,000 sq ft limit. See our Bellingham vs County comparison for a full side-by-side.

Infrastructure Requirements
Your parcel must be fully serviced by sewer and/or septic, and water must be provided for the ADU. Rural lots may need septic/well upgrades costing $15,000–$30,000. See our permit cost breakdown for utility cost details.

Shared Access
The ADU and primary residence must share one access point (driveway). You cannot create a separate driveway for the ADU.

Critical Areas
Wetlands, streams, habitats, and forested areas may limit the developable area of your lot. Properties with critical areas may need a Natural Resources Qualified Consultant assessment, adding $3,000–$10,000 to costs.
