This guide is specific to two jurisdictions with materially different rules: the City of Bellingham and unincorporated Whatcom County. Every rule below names its code section and the date it took effect.

Which Permits a Garage Conversion Needs, by Jurisdiction

Two questions decide your permit path: which jurisdiction the lot is in, and whether the garage becomes part of the main house or a separate dwelling unit.

Rural unincorporated Whatcom County: read this before you plan

Outside an urban growth area, county rules are tighter (WCC 20.80.910, as of 2026-10-05):

  • One ADU per lot, and the owner must occupy the property.
  • Minimum lot size for a detached ADU: 4.5 acres in rural districts, 10 acres in RR-I and the Lake Whatcom Watershed Overlay, 20 acres in Rural Forestry, and 40 acres in Agricultural. A detached garage on a smaller rural lot cannot become a detached ADU.
  • Size: up to 1,248 sf, or 1,748 sf with a density credit.
  • Septic: if your system was designed for the same number of bedrooms the house already has, it is at capacity, and the ADU needs a new system (WCC Ch. 24.05, as updated by Ord. 2025-012). A bedroom cannot be reassigned from the house to the ADU.

Telling you this now saves you a design fee. If the lot does not qualify, an attached conversion or a bonus room for the main house may still be possible.

Lake Whatcom: Usually No

Inside the City of Bellingham, BMC 16.80 bars new ADUs in the Lake Whatcom Reservoir overlay (as of 2026-10-05), with narrow legacy exceptions for pre-1995 and pre-2001 situations. That applies to a garage conversion too, because the result is a new ADU.

In unincorporated Whatcom County, the Lake Whatcom Watershed Overlay requires 10 acres for a detached ADU. The overlay is also excluded from the urban growth area rule that makes ADUs a permitted use. If your lot drains to Lake Whatcom, check this before anything else.

When a Conversion Is an ADU and When It Is a Remodel

The deciding question is whether the converted garage becomes a separate dwelling unit or more space for the main house. A separate dwelling unit has its own place to live, sleep, cook and wash. A bedroom, office or family room that belongs to the house is a remodel.

  • no school impact fee

Under the City of Bellingham's current ADU rules (BMC 20.10.036 as amended by Ord. 2025-12-035, effective 2025-12-23), a lot may have up to two ADUs, attached or detached, at up to 1,000 sf each. The owner-occupancy requirement was repealed effective 2025-12-23. If an older owner-occupancy covenant is recorded on your title, the owner has to file a release.

Garages Inside the Setbacks: Nonconforming Structure Rules

Many older Bellingham garages were built closer to a lot line than today's code allows. In the City of Bellingham, BMC 20.10.036(B)(15), as amended by Ordinance 2025-12-035 (effective 2025-12-23), addresses this directly. An existing detached garage may convert to a detached ADU even where the structure does not meet current setback or lot-coverage standards, and no parking replacement is required.

The catch: zoning relief is not building-code relief. A garage that sits close to a property line can still face building-code limits on windows and wall construction on that side. Its new use as a dwelling also needs current egress, fire separation and energy code. The City lets the building stay put; the building code decides what the wall closest to your neighbour may look like.

Converted Without a Permit? The Legalization Path

Plenty of Whatcom garages were finished into bedrooms or rentals without a permit. An unpermitted conversion is not legal living space, and it can surface at sale, at refinance, or after a complaint. The path to legalize it generally runs like this:

  1. Find out what is on record. Pull the permit history for the property so you know what was approved and what was not.
  2. Decide what the space should be. Legalize it as an ADU, as living space for the house, or return it to a garage.
  3. Apply for a permit for the existing work. Drawings show the work as built plus anything that has to change.
  4. Open up for inspection. Inspectors usually need to see framing, wiring, plumbing and insulation, which can mean removing drywall.
  5. Correct to current code and pass final. Egress, fire separation, electrical and energy code apply as they would to a new conversion.

Cost: expect the permit valuation, plan review and, for an ADU, the impact fees in this guide, plus the cost of opening and correcting the work. How much correction is needed depends entirely on how the original work was done, so we price it after inspection rather than publishing a range.

The Inspection Sequence for a Garage Conversion

Inspections happen in the order the work gets covered up. Each one must pass before the next layer goes on. This is the typical sequence for a garage conversion; your permit card lists the exact inspections the City or County requires.

Under-slab plumbing and any new footing. Drain lines in the trenched slab, and a foundation at the old door opening if one is needed, before concrete is placed.

Framing. The door infill wall, any new interior walls, and the egress opening.

Rough plumbing, electrical and mechanical. Supply and drain lines in the walls, the subpanel and circuits, and the heat-pump line sets.

Insulation. Walls, ceiling and floor checked against the 2021 Washington State Energy Code (effective 2024-03-15): walls R-20+5 or R-13+10, ceiling R-49/60, slab R-10.

How to Permit a Garage Conversion, Step by Step

    Find out whether the lot is inside the City of Bellingham, in unincorporated Whatcom County (rural or inside an urban growth area), or in another city. Check for the Lake Whatcom overlays, which bar or restrict ADUs.

Do I have to replace the parking if I convert my garage?

Not in the City of Bellingham. BMC 20.10.036(B)(15) states no parking replacement is required when an existing detached garage converts to a detached ADU, and the City requires no parking for an ADU at all since its citywide parking reform was made permanent in August 2026. In unincorporated Whatcom County, ADU parking is governed by WCC 20.80.580(63).
